Daruma Audio Open License for Sound Effects

Version 1.1 · Revised 25 October 2026

This is an English translation for convenience. The Russian version is legally authoritative and prevails in the event of any discrepancy.

At a glance: permitted / restricted

  • You may use the sounds free of charge in commercial and non-commercial videos, advertisements, music, podcasts and other works, for yourself or your clients. Your company's size does not matter.
  • You may edit, trim and mix the sounds, use AI assistants in your project workflow, and distribute finished works without limits on the number of copies. Attribution to Daruma Audio is optional.
  • Embedding Sounds in apps, websites, games, services, devices and other Products requires a separate written agreement before such use begins, regardless of revenue, audience size or whether the project is commercial or non-commercial.
  • A separate agreement is always required for system sounds of operating systems, devices (signals of the device itself), voice assistants, platforms and ecosystems, and for audio logos or brand-identifying sounds, regardless of company size.
  • Without a separate agreement, you may not sell, give away or publish the sounds themselves or libraries based on them, or use them to train, fine-tune, test or evaluate AI or include them in datasets for those purposes.
  • You may not claim to have created the original sounds, claim ownership of their rights, or assert claims against other users through Content ID or similar systems.

This summary helps explain the license but does not replace the full terms below.

1. Licensor

1.1. The Licensor is individual entrepreneur Новожилов Дмитрий Владимирович (Dmitry Vladimirovich Novozhilov), Russian taxpayer identification number (INN) 638203824564, individual entrepreneur registration number (OGRNIP) 316631300137578, located in Tolyatti, Russia, operating under the name Daruma Audio.

Website: https://daruma.audio
Questions and separate license requests: sounds@daruma.audio.

1.2. The Licensee, also referred to as "you", is any individual, individual entrepreneur or organization accepting this license. If you accept it on behalf of another person or entity, you must have authority to do so.

2. Covered sounds

2.1. This license covers Daruma Audio sound effects made available by the Licensor with an express reference to this license:

These include Phantom Sound Pack and Daruma Vol. 01 where provided under this license. Future packs are covered when similarly designated.

2.2. The specific sounds are identified by the contents of the published pack, archive or repository version. File counts, names and technical formats may change and do not, by themselves, limit the license's scope.

2.3. The Licensor confirms that it holds the exclusive rights necessary to grant this license. Sounds may be protected simultaneously as works (Article 1259 of the Civil Code of the Russian Federation) and as phonograms and performances (Articles 1304 and 1322); this license grants rights in each such object. The permissions cover the Licensor's copyright and related rights, including rights in phonograms and recorded performances where present.

2.4. This license does not automatically cover logos, the Daruma Audio name, website design, software code or other materials not identified as licensed sounds.

3. Definitions

Sound means a sound effect covered by Section 2, its recording and the protected elements of that recording. Conditions governing a Sound also apply to excerpts and edited versions to the extent that they use protected elements of the original Sound.

Work means a result incorporating a Sound as part of its content, such as a video, advertisement, animation, film, series, podcast, musical composition, presentation, event recording or exhibition composition. A Work must not serve as a means of providing the Sounds for standalone reuse.

Product means an app, website, game, service, device or other solution in which a Sound performs a function of that solution, such as accompanying an action, event, interface, notification, device operation or gameplay. A device is a Product only in respect of its gameplay, educational, entertainment or other content functions running on the device. Sounds that signal the state or events of the device itself, its operating system, firmware or platform are governed by Section 7.1.

Embedding means incorporating a Sound into a Product, or connecting it to a Product, to perform such a function. Server-side storage, network delivery and playback through an external service to perform a Product function also constitute Embedding. Hosting and playback of finished Works are governed by Section 5.3.

4. Acceptance and grant

4.1. This is an open license: a license agreement concluded in simplified form under Article 1286.1 and Article 1308(2) of the Civil Code of the Russian Federation, and a contract of adhesion (Article 428). Its terms are available to the public and placed so that they can be reviewed before downloading or using the Sounds: on the library page, in the license file in the repository and in each pack.

4.2. Any of the following actions, taken after being given an opportunity to review the terms, constitutes acceptance of this license (Article 438): downloading a Sound from the sources listed in Section 2, copying a Sound from the repository, or beginning to use a Sound. Upon acceptance the license is deemed concluded in written form. No separate signature is required. If you disagree, do not download or use the Sounds.

4.3. This license is free of charge (gratuitous), non-exclusive (simple) and worldwide, and lasts for the entire term of the relevant exclusive right. The term of the license is fixed by this Section in accordance with the second paragraph of Article 1286.1(3) of the Civil Code. No periodic renewal or license fees are required for permitted uses.

4.4. Within the limits of this license, you may:

  • download, record, store and reproduce the Sounds;
  • trim, process, adjust volume, tempo, pitch and other characteristics, edit and mix them with other materials (adaptation);
  • incorporate them into permitted Works;
  • distribute copies of those Works, including by sale;
  • publicly perform, display, broadcast, transmit by cable, publish online and make the Sounds available to the public as part of permitted Works.

These permissions apply to original and edited Sounds, subject to Sections 5–8.

The Licensor, as the author of the Sounds or acting with the consent of their authors and performers, gives express consent to the modifications permitted by this Section (Article 1266 of the Civil Code). Modifications that defame the honour, dignity or business reputation of an author or performer are not permitted (Article 1266(2)).

4.5. Exclusive rights in the original Sounds are not transferred to you. Rights in your own creative additions, Works and Products belong to their respective rights holders. This license does not require disclosure of project source materials or licensing the entire result under these terms.

4.6. This license does not restrict uses that applicable law permits without the rights holder's consent.

5. Works and client projects

5.1. Anyone, including large companies, may use the Sounds free of charge in commercial and non-commercial Works, including videos, advertisements, animation, motion design, films, series, podcasts, music, presentations, events and exhibitions.

5.2. You may create such Works for yourself or clients, charge for your services, and distribute finished Works without limits on copies, audience or screenings during the license term.

5.3. Where a Sound performs a function of the Product itself, Section 6 applies. For example:

  • a Sound in an app's advertising video is use in a Work;
  • an app's button or notification sound is Embedding;
  • a Sound in a separately distributed game trailer is use in a Work;
  • a Sound in gameplay, the game interface or a scene supplied as part of the game is Embedding.

Hosting or playing a finished video, musical composition, podcast or other permitted Work on a website or through an app or service does not by itself constitute Embedding, provided that the Sound remains part of that Work and does not perform a separate Product function. This exception does not cover Sounds in gameplay, the interface or a scene supplied as part of a game.

Where uses overlap, each use is assessed separately.

5.4. In accordance with Article 1286.1(2) of the Civil Code, the Licensor offers any person wishing to use a permitted Work created with the Sounds to conclude a license agreement with the Licensor on the terms of this license in respect of the Sounds. Beginning to use such a result constitutes acceptance of that offer. The offer concerns the Sounds only; rights in the creative additions of the result's creator are governed by that creator's own terms. Clients and other recipients obtain permission directly from the Licensor, rather than acquiring rights in the Sound from the project creator.

This Section does not grant rights to embed Sounds in Products. Rights to such use and to transfer Sounds within the relevant project are governed by a separate agreement under Section 6.

When delivering a result for further use, provide the recipient with the applicable license text or a link to that version.

5.5. Sounds may be transferred within a working project to clients, employees and contractors only as necessary to create, edit and operate the specific permitted result. Each recipient must accept this license. Such transfer must not become distribution of a standalone sound library.

6. Product Embedding: separate agreement

6.1. This license does not grant rights to embed Sounds in apps, websites, games, services, devices or other Products. Such use requires a separate written agreement with the Licensor before Embedding or the relevant use begins.

6.2. A separate agreement is required regardless of revenue, user numbers, the user's size or status, or whether the Product is commercial or non-commercial. Working through a studio, agency, freelancer or other contractor does not remove this requirement.

6.3. The scope of permitted rights, fees, term, territory, contractor arrangements and Product distribution terms are determined by the separate agreement. Requests should be sent to sounds@daruma.audio. A request or negotiations do not by themselves authorize use of the Sounds or oblige the Licensor to conclude an agreement.

6.4. Use of Sounds in finished Works hosted or played through Products is permitted within the limits of Section 5. Uses listed in Section 7 require a separate agreement even in that case.

7. Uses always requiring a separate agreement

The following uses are not permitted under this license, regardless of the size of the user or Product. They require a separate written agreement.

7.1. System sounds. Use as default or system sounds in:

  • operating systems, shells and firmware;
  • devices, including smart speakers, smartphones, home appliances and vehicles;
  • voice assistants;
  • platforms, ecosystems and shared infrastructure services, where the Sound signals events of the platform itself or serves as a common signal across several of its Products.

A sound is a system sound where it informs the user of the state or an event of the device itself, the operating system, firmware, voice assistant or platform: power on and off, connection, charging, assistant activation, error, warning, a general system notification, and any sound used as a common signal across several Products of one platform or ecosystem. A sound that belongs to the content of an individual app, game or scenario running on the device is not a system sound and is governed by Section 6.

This restriction also applies where delivered through a contractor, separate app, plugin, update, cloud service or other technical arrangement. The Sound's function determines its classification.

7.2. Sonic branding. Use as an audio logo, brand signature, identifying jingle or other element intended to identify a brand or commercial source.

An ordinary sound effect in an advertisement does not by itself constitute sonic branding unless it performs that identifying function.

This license does not permit registering an original Sound or recognizable edit as a trademark or claiming another exclusive right in it. This does not prevent rights in independent additions or the finished Work as a whole, provided that rights in the original Sound are not appropriated.

7.3. Distribution of the Sounds themselves. Selling, giving away, publishing or making available for download or other standalone reuse:

  • individual Sounds;
  • sound collections, banks, stock libraries and sample packs;
  • sound libraries in plugins, editors, apps or other tools that allow users to select Sounds for their own projects.

This restriction also applies to modified versions where the original Sound remains recognizable and the recording remains suitable for standalone reuse.

Including a file in an app or game solely for playback within that Product as authorized by a separate agreement under Section 6 is not standalone distribution. This provision does not itself authorize Embedding. You need not guarantee that extraction is technically impossible, but you must not intentionally provide an export function or use a Product as a disguise for distributing the library.

7.4. AI training and evaluation. Using Sounds, excerpts, processed copies or features derived from them as material for training, fine-tuning, testing, checking, benchmarking or evaluating neural networks or other AI systems, or including them in datasets intended for those purposes.

8. AI assistants and protection of rights

8.1. AI assistants may be used to find, select, process and insert Sounds into a specific permitted user project. Necessary technical copies and temporary service-side processing are permitted, provided the service does not use the materials for Section 7.4 purposes or make them available to other users as standalone Sounds.

Ordinary listening and checking the quality of your project's result do not constitute AI testing under Section 7.4.

8.2. You must not claim to have created the original Sounds or claim exclusive rights in them.

8.3. You must not register or use the Sounds in automated recognition and rights-claim systems, including Content ID, in a way that results in claims against permitted use of the same Sounds by others.

A finished Work may be registered only where such claims concerning Daruma Audio Sounds can be excluded. Erroneous claims initiated by you or persons acting on your behalf must be withdrawn promptly.

9. Attribution

9.1. Crediting Daruma Audio is not a condition of this license. The Licensor, and the authors and performers of the Sounds (by consent obtained by the Licensor), permit use of the Sounds without attribution. This does not affect the right of authorship or other moral rights that authors and performers retain by law.

9.2. If you wish to credit the source, the recommended wording is:

"Sounds: Daruma Audio (daruma.audio)."

9.3. Attribution does not imply that Daruma Audio endorses or participates in your project.

10. "As is" provision and liability

10.1. Sounds are provided "as is". Other than the express confirmation of rights in Section 2.3, the Licensor does not promise fitness for a particular purpose, compatibility with your hardware or software, absence of technical defects or continued library availability.

10.2. You are responsible for checking suitability for your project.

10.3. To the extent permitted by Russian law, the Licensor is not liable for losses caused by technical defects, incompatibility or inability to use the Sounds, including lost profits and replacement costs.

In relation to a Licensee using the Sounds for personal, family or household needs, this limitation applies only to the extent permitted by consumer protection law.

This limitation does not apply to intentional breach or other cases where exclusion or limitation of liability is prohibited by law. It does not negate the confirmation of rights in Section 2.3.

11. Breach and termination

11.1. Use outside the granted permissions is unauthorized from the outset of that use. A period for addressing a breach does not authorize its continuation.

11.2. The Licensor may unilaterally withdraw from (terminate) the license, in whole or in part, by notice (Article 450.1(2) of the Civil Code of the Russian Federation) in the cases provided by law, including under Article 1286.1(4) where you grant third parties rights in the Sounds, or in results created on their basis, beyond the rights or on terms other than those provided in this license.

Where use relates to both parties' business activities, the Licensor may also withdraw from the license: for a breach of Sections 6–7 or Sections 8.2–8.3, by giving notice; for any other breach of these terms, if the breach is not remedied within 15 calendar days after receipt of notice of it. Withdrawal takes effect upon delivery of the notice or upon expiry of the cure period, unless the notice specifies a later date.

In other cases, termination occurs by agreement, court decision or another statutory ground.

11.3. After termination, you must stop creating new results using the Sounds, stop new deliveries and distribution of materials containing them, and remove or replace Sounds in publications you can modify and Products you operate. Closed archival copies may be retained as evidence of use, without further exploitation of the Sounds.

11.4. Termination does not retroactively make previously authorized acts unlawful. Licenses that third parties obtained directly from the Licensor under Section 5.4 are independent agreements and do not end because the breaching party's license has ended. Rights already obtained by good-faith third parties to use lawfully released results remain effective within the applicable license. Lawfully distributed physical copies need not be recalled, and end-user copies need not be forcibly deleted.

Preserving those rights does not permit the breaching party to continue its own distribution, publication or exploitation of the Sounds after termination.

11.5. Remedying a breach does not automatically reinstate a terminated license. Reinstatement requires the Licensor's written confirmation. Statutory claims and remedies remain available.

12. License versions

12.1. The Licensor may publish new terms for future downloads. A new version does not by itself change the terms applying to previously obtained Sounds.

12.2. A previously downloaded Sound remains subject to the version under which it was obtained. Downloading the same Sound again does not revoke previously granted rights. New or modified Sounds may be supplied under new terms.

12.3. You are encouraged to retain the license text with the files, acquisition date and pack or repository version identifier. Failure to retain a copy does not by itself terminate your rights, but may make the applicable terms harder to establish.

13. Governing law and disputes

13.1. This license is governed by the law of the Russian Federation, subject to mandatory rules applicable regardless of the choice of law.

13.2. The parties must first send a written claim describing the disputed use and requested remedy. Claims to the Licensor must be sent to sounds@daruma.audio. The response period is 30 calendar days after receipt unless mandatory law provides a different procedure or period. The mandatory pre-trial procedure applies to disputes relating to both parties' business activities. A Licensee using the Sounds for personal needs may, but is not required to, send a claim.

13.3. If a dispute is not resolved, disputes relating to both parties' business activities are referred to the Arbitrazh Court of the Samara Region; other disputes are referred to a court under the applicable procedural rules, including a consumer's right to choose the court. This section does not prevent urgent protective measures permitted by law.

13.4. The Russian text is legally authoritative. This English translation is provided for convenience. The Russian version prevails in the event of any discrepancy.
